Limitation on Liability: WITH RESEPCT TO A BREACH OF THE MANUFACTURER'S PRODUCT WARRANTY, WCC'S EXCLUSIVE LIABILITY SHALL BE TO REPLACE OR REPAIR OR PROVIDE A REFUND FOR SUCH DEFECTIVE PRODUCT, BUT ONLY IN ACCORDANCE WITH THE TERMS, AND TO THE EXTENT OF PANGEA'S THEN CURRENT NATIONAL PRODUCT RETURN POLICY AND AS SET FORTH HEREIN. IN NO EVENT SHALL PANGEA BE LIABLE TO PURCHASER FOR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, RELIANCE, SPECIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA OR USE, WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF PANGEA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL PANGEA'S LIABILITY HEREUNDER EXCEED THE AMOUNT PAID BY PURCHASER FOR THE PRODUCTS THAT ARE THE SUBJECT OF ANY CLAIM HEREUNDER.

Taxes: All taxes applicable to the sale or delivery of the Products and to subsequent use of the Products by Purchaser, including but not limited to any sales, value added or use taxes, shall be paid by Purchaser.

Shipping and Delivery: Each Order shall be shipped to Purchaser via a third party. Products shipped via a third party, product shipment will be F.O.B. WCC's location, and title and risk of loss or damage shall pass from WCC to Purchaser upon delivery to a common carrier or Purchaser's representative at the F.O.B. point. In such events, Purchaser must file all claims for damage directly with the carrier. Furthermore, WCC will select the carrier for shipment, but, by doing so, will not assume any liability in connection with shipment, nor shall the carrier in any way be construed to be the agent of WCC. While WCC will endeavor to provide the Products to the Purchaser by the "required by" date, if any, reflected on the Order, WCC makes no guarantee that such date will be met, and disclaims any and all liability for failure to meet such requested date.

Returns: Returns will be accepted within one month of the date of purchase with original receipt. Returns will only be accepted in accordance with the procedures provided in WCC's return policy.

Waiver: The failure of WCC to enforce, at any time, any of the provisions of this Agreement or to exercise any election or option provided herein will not in any way be construed as a waiver of such provision, election or option.

Applicable Law: This Agreement shall be governed by and construed according to the laws of the Commonwealth of Virginia without regard to its conflict of laws rules. Any dispute arising hereunder shall be adjudicated in a court of competent jurisdiction in the Commonwealth of Virginia.

Severability: In the event that any portion of this Agreement is held to be unenforceable, the unenforceable provision shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties and the remainder of the provisions shall remain in full force and effect.

Force Majeure: In the event either party's performance hereunder is interrupted or delayed due to causes beyond such party's reasonable control, such as acts of God, acts of any government, war or other hostility, the elements, fire, explosion, power failure, strikes or work stoppages, inability to obtain necessary supplies and the like, the period of performance shall be extended for a period of time equal to the interruption or delay.

Notices: All notices required to be given hereunder shall be in writing and personally delivered or sent by certified or registered mail, return receipt requested, postage prepaid, to World Craft & Café, Inc. dba PANGEA at 6551 Loisdale Court, Suite 320, Springfield, VA 22150 or to such other location as PANGEA may designate in the manner specified herein, and to Purchaser at the address designated on the attached Application form, unless notified by the Purchaser to the contrary in the manner specified herein

Entire Agreement: This Agreement contains the entire understanding and agreement of WCC and the Purchaser regarding the subject matter hereof and all other contracts, purchase orders, discussions and communications are superseded hereby. There is no agreement, oral or otherwise, which is not set forth in this writing. Except as set forth in the "Amendments" paragraph above, no amendment or modification of this Agreement shall be binding unless in writing and signed by both parties. Miscellaneous. This Agreement may not be transferred or assigned by Purchaser without the prior written consent of WCC and is binding upon and shall inure to the benefit of Purchaser and WCC and their respective successors and permitted assigns. This Agreement may be executed in one or more counterparts, each of which shall be deemed an original. The headings used in this Agreement are for convenience of reference only and shall not affect its interpretation or construction.

Privacy
We do not sell or rent Your personal information to third parties for their marketing purposes without Your explicit consent. We may disclose personal information to respond to legal requirements, enforce our policies, respond to claims that a listing or other content violates other's rights, or protect anyone's rights, property, or safety.

The information you provide to WCC will only be used to process your order. Unless there is a problem with your order or you have opted to receive the Pangea Journal by email, you will not be contacted by WCC. If you do opt to receive the Pangea Journal but later change your mind, you can request to be removed from our list by simply emailing us at remove@pangeamarket.com. Should there be any changes to WCC's Privacy Guarantee, all affected users will immediately be notified by email and all relevant changes will be posted to this portion of the site.

This site’s shopping cart is hosted by ProStores (an eBay company) and that ProStores, including its service providers, parent entity and affiliates, have access to aggregated information related to WCC’s customers in order for ProStores to analyze performance and make improvements to ProStores Services and products.
